NCP not reporting all income

NCP works two jobs but has only reported one to court. The unreported job is paid as an independent contracter, so county can't track it. With this second job, NCP's income is significantly higher than it was when support order was written.

It's my understanding that in order to file to raise support, I have to be able to prove NCP is making more money. Does anyone have any advice on how I can go about doing this? NCP isn't going to just volunteer this info. Thanks.

Could you send a certified letter to his second job? Contact the business in which he works as an independant contractor? Is your child support case handled through the Child Support Enforcement Agency? If so, perhaps you could report your findings to them and see what they may have to suggest.

My son's father worked for a friend and was paid under the table for the first two years of paying support. I recieved $68 a month in support, and accepted that because I found it more of a hassle to waste my time trying to prove NCP wrong...I basically dealt with the fact that bio dad wasn't contributing hardly anything towards our son's welfare, and adjusted to that. Now, bio dad has a better job that where he can't falsify his earnings, and with time, his child support increased. Just a word of advice-unless the amount of support your paid is significantly low, I wouldn't worry with it. Good luck.

Thank you, Ashlee. One of the problems is that I don't know the name of the second employer. I've spoken to my caseworker and was told that it's very difficult for them to enforce support with independent contractors if NCP won't cooperate.

NCP has begun working less hours at reported job and isn't making enough money per check to make full support payments. My fear is that eventually NCP will quit first job and only work second, so I"d like to get it on record if I can. I know I can take NCP to court for contempt once arrears reach a certain level, but that won't help my child's current financial needs. It seems like a losing battle, but I thought maybe someone would have suggestions... Thanks again.

A child support review is conducted once every three years. Is your case anywhere near that mark? I'm racking my brain for ideas...I know how frustrating this can be. Bio dad lives 5 minutes from us, and I watched as he drove fancy cars and dined in nice restaurants while I scrapped to support my child, all because he cheated the system. One I first requested a modification for support, I was told that I would need to bring in proof that I needed more support. At the time, my son's daycare was $75/weekly, more than a month's worth of support! Once I got bio dad to court, the beans were spilled. Everything was taken care of there, and the correct amount was ordered.

The best advice I could give would be to either try filing a motion for increase, meanwhile, bust your buns trying to find out where this man works! Good luck!
