What is the name of your state? North Carolina
While on vacation in Cumberland County North Carolina in August 2001 I was arrested for DWI and released on a $500 signature bond.
I returned to Maryland and never went back to NC to face the charges. I have been told several times that a FTA warrant was issued, but it is a non-extradite(sp?) warrant. I now hold a class A CDL and drive over the road. I have had no problems with obtaining a license until last month when I went to add endorsements to my CDL and they told me I have to fix NC before they would issue my new license in Maryland.
My question is this - first, is there a statute of limitations in NC on DWI. And second, how long before the prosecutor would consider this case stale.
Facts of the arrest - I was not pulled over by a police officer. I was racing another soldier up the road and ran a red light. I broke loose and did 2 - 360's and continued up the road behind the other guy. He pulled into a gas station to wait for me, I slid to a stop next to him. We were talking for about 30 seconds and a probation officer blocked us in. I went to the bathroom when he did that. Before I was done in there Cumberland County Sheriff's office came in and escorted me back to my car. At that point they did a field sobriety test on me... no breath test. We got half way thru and I said the hell with this and turned around and asked for the cuffs and to go to the station. They were happy to help me out with that.
I blew a .16 twice in less than 10 minutes at the station, never blew at the gas station. Since then I have been told by several Dept Of Transportation officers in many states that I have that warrant out for my arrest. They also keep telling me that this will never go away and I need to turn myself in.
I am aware that many states have a statute of limitations in place to avoid trying to prosecute stale cases. How long before NC considers it stale?? A DWI conviction will disqualify me from holding a CDL and will have to find a new career. I have not had ANY alcohol related incidents before or after this one when I was a young and dumb 21 y/o. I don't even drink at all now.
Anyone have first hand knowledge of North Carolina law pertaining to old DWI's??
