What is the name of your state? Nebraska

Hi, we just moved out of a house my husband and I were renting. We moved out July 3rd and by nebraska law, the security deposit is required back to us if applicable by 14 days of leaving. My question is, we can prove that they did not send us the itemized list of damages/repairs within the 14 day period. Does that mean they are not entitled to it ?

Also, they also have claimed that they painted two rooms, one was a 6x8, the other 8x10 (rough estimates here, not 100% sure, but really close). For the two rooms, they charged 500 dollars just to paint white (we did not paint horribly dark colors or anything, they were just sage green and blue). Is that above and beyond the scope of normal charges? I think that is rather high just to paint two rooms.

Thank you for any help

Yes they are entitled to it, or yes they are not? Sorry, my original question was a little open i gues. I have read the Tenant Landlord handbook like 5 times, makes no mention if the landlord is late on giving you their itemized list of deductions. I have a postmarked envelope showing they mailed it roughly 20 days after the move out date. Not to mention, their prices on painting are way too high.

First off it is not up to you to prove they sent it to you it is up to them to prove they did, hence the yes answer to they cannot keep your deposit if they did not send it in time.

Now as to the second yes. Again if they did not send the notice in time they cannnot keep any of your deposit for any reason. Also it was my opinion that the 500 was to high for 2 rooms.
