What is the name of your state? California
We have rented our house for 9yrs with signing a 1 yr. lease each year. Our last lease was up at the end of Aug. 2005. We are in the process of buying a house, which we are moving into on Nov. 1. We let the landlords know we did not want to renew our lease and would like to stay until Oct. 31. They declined & want to leave by Oct. 1. They did not give us any written notice & are badgering us to write up a 30-day notice letter. We were advised they needed to give us a 60-day notice. Our Sept. rent was paid, but has not been cashed. We received a message saying they will return our check & start eviction process. What are our rights? Can we stay until Nov. 1? The lease states, "any holding over at the expiration of this lease shall create a month to month tenancy". What should we do? Should we stay & send them a rent check for October? We do not want to squat and willing to pay until Oct. 31. Please advise soon as they are badgering us with messages on our answering machine wanting to pick up the 30-day letter notice & talk of eviction. They state they have sought a lawyer.

Tell them the law states 60 days notice, if they want to tell the judge they do not care then good luck to them.

Write them a 60 day notice you are leaving.

Save all mesages they left you for the judge if it goes that far.

They do not have a lawyer if they did the lawyer would advise them to give you 60 days, if they tell you their lawyer stated otherwise, call their bluff and ask for the lawyers bar number.

What is written? What is oral? What is What? I read this over and over and still did not get what is WHAT! It is so important and I am not being rude I am being factual and so will a judge... Okay :)
