My x-boyfriend gave me $2,000 dollars as a gift for a vehicle because at that time I wanted to move back to my old home in Delaware from NJ with him and get my life back together, all the sudden as I moved he told me he wanted this money back, me considering the money I gave to him over the last year for help and bills told him no. No it has been since Nov. 2000 since this money was given to me and now he wants to take me to small claims court. Can he do this, will it hold up in court? The money was put on a visa that we both had together and still have....I guess what I need to know is...Will this hold up? its been 8 months since he gave me this money....I need advice ASAP! I am not sure about Deleware, but 8 months is not a long time at all in this situation. Thus, it is likely it will hold up.

If it was a gift, it was a gift. And you will not have to pay. If it was a loan, then you do. It is his burden to prove it. Whether or not you helped him out on bills does not support that you two never had a loan or contract concerning the money.
