Ok here's the situation I sold some one some products online not through an auction just independently. Transaction went smooth until FEDEX got their hands in it. Basically, payment was received, check cleared, package shipped, package lost. The buyer used his own account and did not insure the package or give it a declared value. He received a package that was not mine, my shipping label fell off of my box and ended up on someone elses the package arrived at my buyer's location with the two labels attached meaning my box is in limbo with no labels. What rights do I have to keep the money seeing that Fedex's negligence on delivery and his to insure or declare value on the package seeing how Fedex might only give me 100 dollars for a 1350 dollar shipment?

Have you ever watched the FedEx people properly put a label on a package? Those things don't just "fall off". Either the clerk didn't put the label on correctly, or he/she didn't put it on at all (or somehow while sleeping, put both on one package). If you have a receipt that shows you handed them the package, paid for shipment, and they accepted it...then they are liable. Unless you specified that you would provide insurance, your buyer was responsible for his own (especially on his account). The ball is out of your court. It is between FedEx and your buyer.
