Georgia. Have sold our home. Contract on custom built new home we are to close on in 9 days. We no longer want this home, given its location, school, etc. How to best proceed. By the way, we had conflicts with the builder along the way.

Home is custom built, with lots of upgrades. Builder is one of the best in our county - has a reputation for building hi quality, beautiful homes. As such - he is a little cocky about it too. Homes in this subdivision are currently priced from the high $270's to the most expensive home (custom built by our same builder) $740,000. Most homes fall in the $300's to low $400's - ours will be right around $400 with all our upgrades. This subdivision has 4-5 builders, with our builder being known as the best, but also the most expensive, because of the upgrades and quality he puts into his homes.

Which option seems best & most financially feasible?
1) Proceed with the closing, then immediately put up a for sale by owner. (There are several other new homes being built around us now - and since people are looking to move before the new school year, should see a lot of traffic).
2) Ask the builder to get out of the contract and ask for our money back.
3) Proceed with closing, wait 6-12 months and do for sale by owner.
4) Who else should I talk to about this? Should I ask a real estate agent?
5) Do you know of other possibilities? I have heard of some builders doing 'trades.' What do you know about this?

Put the property on the market now with the best listing Realtor in the area. You may be ble to do an assignment of the sales contract so the Buyer takes over your position or back to back closing
Hire an attorney to review all contracts ie. you and Builder, you and Buyer etc.

Homeguru - do you mean put it on the market before we close?That is only 9 days away. And if so, if it does not sale in that time period, this means we just move forward with closing and then list and try to sell, like selling a home any other time?
