Need Advice Like Asap!!!!!! Need Answer Before Court Date--6/16/04

My brother in law's wife walked out on him and my niece to live with another guy. She was gone for 2 1/2 weeks, came back for 3 days and left again. My brother in law has been taking care of his daughter. He has filed for divorce and temporary custody. She challenged the child custody and so they have to go to court Wednesday to decide who gets custody. The lawyer called it an ex parte hearing. What does that mean and what can we expect? Also based on the following facts--who is more likely to win child custody?

1. Mother abandoned child and father to live with another guy
2. Father has an established support system--my husband, my other brother in law, grandmother of child, grandfather of child, aunt of child, and second cousins of child.
3. Neither parent is employed. However, Father has filed for Tanf and receives food stamps and medicaid for child
4. Child (age 3--will be 4 on 6/27/04.) said "Please dont let my mom and that ugly man take me"
5. Mother already has lost 3 other children from previous relationships to the system because they were not being taken care of.
6 Mother has shown herself to go overboard when it comes to matters of discipline(either not at all or too much--leaving marks)

Im sorry this is so long but i had to give all the facts. Please help me as soon as possible and thank you so much in advance.

Based on what you have said. My best guess is the father will get temporary custody until the actual custody hearing.

2 questions....

1) why doesn't dad work?
2) when she lost the child, did the state terminate her rights? Did she just give up custody? how did she lose them?

They aren't divorced. He filed for temporary custody, and she is challenging that and is asking for custody. Nothing has been awarded yet. That is what Wednesday is for.

I am asking how she lost these children, like what was the situation: termination by the state, custody battle, giving up?what?
