Today, March 21, 2009 - I just received an urgent late notice that states I have a balance due for late fees, 3 day notices, owed rent and/or other misc charges. Attached to their letter is a copy of my ledger for my review. The notice indicates that I have to pay the full amont in the office no lather than March 27th to prevent it to be turned over to the credit bureau. After overlooking their attached ledger they sent me the only discreptancy I noticed was rent owed back in December 2007 of which I paid a portion of my rent amount that is normally due each month. I went back into my bank statements to see why I only paid a portion of my rent. The check I wrote for Dec '07 month was written 12% less than and stated it was due to a discount in rent and also included a previous late fee that I had owed. I remembered back in Dec '07 my duplex that I am renting had a leaky roof. I called the maintenance tech with the rental company and informed them with all the work that needed to be done to fix the leaky roof and the inconvenience that is putting the renter (myself) - 1) the duplex suffered severe water damage which took workers 3 wks to fix/they had to replace the entire roof and siding of the master bedroom's back wall and 2) due to the leak in the roof - rats/rodents were able to get in & had to exterminated per health/saftey reasons I felt I should get a discount in rent. Due to the amount of inconvenience they put me in the rental company had verbally agreed that I pay a portion of my rent for the month of December. Though I argued I should had half off as the work extended over 1/2 the month of Dec. - the owner/rental company did agree upon a 12% discount would suffice. I stated this on my check as proof of this verbal agreement (via phone) but, our agreement was not in writing. Now, I have this notice and don't think I should have to pay the missing balance. I also found it odd that this is the 1st time I am hearing about this issue and that it took them this long to collect for the missing balance - keep in mind this occurred back in Dec 2007 - almost 1 1/2 years ago. My question is do I have to owe the balance? How should I approach the rental company per this issue?
