What is the name of your state? mass
hello
There is a website called dontdatehim.com
A couple of months ago, an ex of my boyfriends copied and pasted a picture of us and made a profile
on him on this datedatehim.com
saying some pretty nasty things about him and myself.
I would like to know if there is anything i can do to have this profile/picture removed
from this website?
I tried contacting the webmaster but of course they dont respond.
Thank you

Defamation suits have been brought against posters on that site. Opinions are not considered defamation but it is a fine line between what is posted as opinion and what implies fact. The veracity of the comments made enter into any defamation suit, as well. If all that is posted is true, there is no actionable defamation. There could be, however, an invasion of privacy action.

Continue to try to contact the webmaster to have the offending material deleted.

Thank you so much for responding
they are making fun of personal anatomy if that is a good way to put it
making fun of the picture and saying derogatory statements about me
saying things that are not true (cheating lying saying he is a bad father ect )

storys are made up, will not get into to much detail but truth has turned into added lies so to speak to make him look bad she vowed to ruin any relationship he trys to have.

They are also being disrespectful to us about our kids and their well being.
we are ignoring all of their attempts to bother us but if we asked them to remove the posting and they don't does that mean it is harassment or slander at all?
thanks again
just really want posting down from the site.

It could potentially be libel (libel is written, slander is spoken) and harassment and invasion of privacy. A cease and desist letter might be appropriate. And continue to try to get the website to remove the offending material. That site has caused a lot of headaches for a lot of people, it seems.

There is nothing to stop you from posting rebuttals on that site. You can also comment on other people.

Just be CAREFUL what you say about others.

thanks

what does cease and desist letter consist of?
and to
Quaere, thanks ,but not interested in doing the drama thing of posting back and forth with her and wasting my time, just want posting down.

another question quincy...
she took a picture that belongs to me , copied it from the net, and used it to make this profile . since the pic is mine does that break the rules of dont date him which is no copywritten material? a picture is copywritten soon as its taken by the owner , right?
also rules of dontdatehim is no false statements, harrasement ect.
webmaster still not responding i am writing them again

A cease and desist letter is basically a letter that says to knock it off or else. You can find sample forms to copy online.

I almost asked you about the origin of the photo earlier - I was thinking copyright infringement, too. Yes, if the photographer was not the ex or someone who may have given the ex the right to use the photo, then it would violate the photographer's copyright. It also, apparently, violates the website rules, although they don't seem too concerned about false statements on that site, from what I've read and heard. You might mention the photographer's copyright when contacting the webmaster again. Sometimes it takes awhile for a response.
