Here is main issue (with many questions pertaining): Father told mother that child did not want to see her ever again. And also told child the mother did not want to see her and would no longer be in her life. This belief lasted for about 5 months where mother and child did not get any visitation due to fathers unilateral decision, violation of court order to halt any and all contact between mother and child. Father was forced to allow visitation with mother and daughter with therapist in Reunification Process. Child has been undergoing therepy with mother with court appointed therapist who was suggested by father (she is also in high favor from courts perspective) but she does have long history of being therapist for fathers new wife and two bother Father and new wife more recently. Therapist told court mediator that child is scared to talk to mother and that both parents have problems making meetings. It should be noted that child was scared to talk to mother due to fathers anger at her after she talked with mother and that mother never was late for any meeting and only cancelled one meeting in which she gave notice two days in advance due to her mother breaking her hip. Now the court basically relied on Mediators report...and mediator essentially relied on theapists report, which I am sure is fairly common practice.
Some questions I have about this case: Is Father not guilty of some form of abuse on both mother and child?
and should therapist not be responsible to immediatly make court
and mediator knowledgable of inacuccacy of previous report and new discoveries as she has been appointed special master of this case?
Needed some advice on helping a women who has lost the custody of her child...After looking into this case I was amazed at the injustice of this particular case, thus as one who generally believes in US law that this case had so many unanswered questions.
First why did mother loose custody of child?
Mother did have one drug conviction when over 3 years ago..for cocaine use when child was not in her care. It was actually one of her first eekends not to have her child in her care (responsibiltiy) since child was born (child was 11 at the time). Father of child has multiple arrest for domestic abuse on mother of child and other women as well. As well as a long rap sheet of arrest...mostly concerning assault, drugs and resisting arrest, assault on officer. Mother also moved in with boyfriend who has not arrests or criminal history beyound those involved in driving a vehicle...DUI most significant. But he does have a pit bull dog and a father on Megans List who owns the home where she was living but does not recide there or live in close proximity. Mother has fulfilled all request by court...drug court (6 month voluntary program in exchange to have arrest ex-punged, parenting classes where teacher actually offered her a job helping and running her own classes. Mother was never explained why child was removed from mothers supervision...but was stated that due to her neglect of mother to put child in danger of abuse due to the owner being a membetr of Megans list...it should be noted that mother nor anyone else who knows the long time tenant of the house new of any such offense by owner of house sexually abusing anyone.
Well father has continually harassed, stalked, and mentally abused mother for the last 6 years or from the time of his last physical assualt on her. He was continually controlling mothers visits since he gained custody. Alwasy being late in delivering child yet still maintiaining the sceduled time frame with respect to pick up of child. At times being up to 2 hours late for a3 hour visit. Many documented instances of Father thorting visitation or alianating child from mother.
Well her is one question: Father beginning last summer has violated court order with respect to mothers visitation. After a altercation between mother and father's new wife (who was per court order not to be involved in visitations of child between parents.) Well after altercation...verbally attacking one another the father called mother and stated (which are supported by witnesses at the time of call (s) . "you ****ing ****.....why don't you kill yourself", "[Daughter] does not want to see you anymore, dont call her anymore. And for next 5 months would not let mother or daughter talk, verbally abused mother on attempts to make contact. Mother tried to haver local police department support her rights to have visitation but they stated that they do not get involved in child custody cases. And after one call where mother expressed fathers threats for her saftey called concerned about daughters safety and seemed to thing he might be using alcohol and drugs again. The police report was not maqde by the officer who recieved call but another office who had an intimit relation ship withFather's new wife. She has had 2 physical relationships with the small towns police officers. So there is just some of the info that I feel is relative to case or most pertinant to case. Should also be noted that mother was furlouged from her travel industry job a year and half ago, and for approximatly a year did not have her own place to live...that is without roommates, or the Megans list home. She now does have a nice home for visitation and possibly custody if justice is ever served.
