What is the name of your state (only U.S. law)? North carolina.
My husband and i separated for 8 months. My friend had moved in and well we broke up in July. He was in the process of finding another place to live so i told him he had to go as soon as he found somwhere. I left the house to go to my sisters house(mainly to stay away from him) I got a call a couple hours later from him saying he had fell and hit his jaw. I came home and it was broke. I asked him what happened and he said he took a pill(which was a perscription from one of my friends) amatripaline which is a antidepressant and sleeping pill.. then he said he had a few drinks(alcohol). since then my husband and I have gotten back together and i got a text that he was gonna sue me for him breaking his jaw.
I have insurance through my mortgage company not homeowners.
Please give me some advice on where i stand in this.

Where ever the duplicate post is. the ins co does not pay for people who hurt themselves on there own property. especially when there on illegal drugs.

p.s the ins thru the mortgage is homeowners.

I dont get it. husband / lover . whatever.

But as far as people falling randomly in homes they dont own. I think if you can prove somehow the person was under the influence of illegal substance and thats why they fell... (how that can be proved, I dont know.) the insurance is not going to pay it, and if it comes up civilly the judge might not award money to a intoxicated drug abuser. (mind you this must be proven in some way, not he said she said.)

My question is if the lover was living there does that make a diffrence? how about a Renter. or is it just people who own the house and imedeate family that are excluded. ??

**A: it actually depends on the fine print on the insurance policy.
The last one I read excluded drunken and drugged out lovers falling down and breaking the jaw.

Well, depending on the documentation you have of him living there, if any, you may have a liability, still. if you allowed him to take drugs and drink on the property (left the house with him in it and did not explicitly tell him to leave, drink, or take drugs) then you may still be liable in the eyes of the law.
