What is the name of your state (only U.S. law)? North Carolina
This deals with NC GS 15A-145.4
The first thing I need is clarification on some of the language in this law. I qualify to get this expungement after 31 years and I plan on petitioning for it to be done. However, there is a list of affidavits that I have to file with the petition and I want to make sure that I have them correct before filing.
"Verified affidavits of two persons who are not related..."
What do they mean by verified affidavits? Do they need to be sworn to and notarized or do I just need to give the court contact information for the people that give me these affidavits?
The other thing is where it states that I must "serve a copy of the petition on the district attorney." Is this something I must do or have done or will giving a copy to the Clerk of Court take care this?
I think I can handle this if I have these two things cleared up for me as to what is the correct way to handle them. Thanks in advance for your help. I will put links below to instructions, forms, and the statute itself to help with research for these answers.
