Please forgive the long post, but I need to give some background info. I live in Covington County in Mississippi. (have lived here all my life). I have been a certified teacher for 6 1/2 years. 6 of those years I've spent trying to get a teaching position at the school that I attended for 12 years, which is now the school that my two kids attend. It seems that the principal will not hire a male teacher to teach on the elementary level. (the school is k-12). I left Hattiesburg Public schools to teach at MT. Olive, thinking I'd get my foot in the door in the county. I taugh there for one year as a regular ed 3rd grade teacher. After that year, the position was no longer available due to a decrease in students. I was told that the only teaching position open in the county (there are 4 elem. schools in our county)was a special ed position in high school at the attendance center that I had taught 3rd grade in. I accepted the job, after having gotten an emergency certificate in Special Ed. from the state dept. of ed. I was told that I'd have to take 6 hrs in college in spec. ed within a year if I wanted to continue teaching spec. ed. and eventually get a total of about 30 more hrs to get an add on certification in spec. ed. I was not interested and asked to be transfered to a regular ed. position. The county did not renew my contract, did not notify me in writing that I was not going to have a job. That took place 4 years ago. I spoke to an attorney, and was told that the county could be made to give me a job, since they failed to notify me in writing that I was not going to get a contract, but I chose not to pursue that. Has it been too long to do anything about that?
I presently teach in a neighboring county. I've kept my application up to date at the Covington county office. This past April, I spoke to the attendance center principal at the school that I want to teach in. He said he'd LOVE to have me there and that there may be a position that will be open for the next year. About a week ago, a 6th grade teacher resigned, so I called the principal. He made excuses, so I asked to see him in person. The next day we met at the school where he proceeded to give me a big spill about having to hire a new football coach and his wife just happened to be certified to teach elem. and they had decided to offer her the job so that her husband would stay more than one year. My question is this: do I have any legal rights in this situation?
