First of all let me say sorry for this being so long.

In July my husband & I had a message on our phone from a realtor asking if we would be interested in selling our home even though it was not for sale. After talking it over we agreed that if we could find a place we would sell. Then a few weeks after looking for a home we receive a call telling us that the buyers had made an offer and that we needed to decide with in 12 hours or the buyer would be going to an auction and the deal off.

My husband & I had it posted in our purchase agreement "Buyer to provide seller possession of the property for 30 days after closing at no cost to the seller other than utilities. Sellers to rent property for $535 a month after 30 days".

We closed on our house 10/4 and that evening we got a call from the buyers asking us when we would be out. We told them that we were trying to find a house as soon as we could and that we had in fact made and offer and were in the process. We also stated we would keep them updated.

On October 9 the buyers called and left a message telling us to be out by December 5, 2007. There was no written notice only verbal. But we have legal binding contract stating we can rent after 30 days. There is not date or time limit on the purchase agreement. So my question is can they evict us? Do they have to show a reason? How much notie do they have to give and how does it have to be given to us?

Please help with any advice you have it would be very much appreciated.

Written notice is required.

But we have legal binding contract stating we can rent after 30 days. There is not date or time limit on the purchase agreement.
Since there is no specific term, you are month to month tenants.

So my question is can they evict us?
Yes, after giving proper written notice and if you fail to vacate by the termination date.

Do they have to show a reason?
No cause or reason is needed to terminate your month to month tenancy.

How much notie do they have to give and how does it have to be given to us?
Check your state's landlord tenant laws. Generally, a written 30 day (full calendar month) notice is all that is required.
