What is the name of your state? New Mexico
We filled chapter 7 4 years ago and included a house we lived in. They never foreclosed on this and the records shows the house stills belongs to us. Last week they sold it at an auction for back taxes. Now we have recieved a letter stating any money recieved over the back tax is ours and all we need to do is send them proof of previous ownership. The house has been abandon for over 4 years. Did the bank just write this off and is this money ours?

Did you let the house go in the bankruptcy ?
Are you sure it was never forclosed on ? That would be rather odd.

I'd call the courthouse, talk to whoever handles deeds, and find out what the status was prior to the tax sale.

If the deed reverted to the bank after your bankruptcy, then you're not the last owner - the bank was.

New Mexico, I called the courthouse and they said our name was the only one on the deed the bank never foreclosed.
