Hello, I received a summons for civil action from my husband. He lied to his lawyer. I want to know if I am able to file for divorce on the grounds of domestic violence, abandonment, neglect, mental anguish and adultery. I stated to me that he was mad when he filed this paper against me and he did not want a divorce. I do not want one either but if he goes through with this I want to be prepared. I do have some proof of the things that I have listed above. According to the papers I received, he wants to get a divorce without having to pay me alimony and a no contested divorce what is it that I can do to stop procedure.

You get yourself an attorney to respond to his petition for a divorce and for a contested divorce, listing what you want.

Nobody can really tell you any more than that since you did not answer the important question as to what state you are in.

How long were you married and what were your respective incomes? It might make sense to determine if your are alimony-eligible before putting all that energy into proving infidelity and mental anguish.
