Hello,

What is the correct legal term when someone marriages someone who is incompetent?

For example, my father had alzhemier's and he married someone. My father did not even know he was married.

My response:

That would be called a "void" or "voidable" marriage - - subject to annulment - - but ONLY if can be proven that at the moment of saying "I Do", your father was stricken with Dimentia.

Has there been a Dimentia diagnosis, by a doctor, predating the marriage ?

Yes, my father had Dimentia diagnosis, by a doctor, predating the marriage. Approximately 5 years prior.
