I'm not sure this is the right sub-group but seemed like the most likely. I also apologize up front for the length. Question: Is the following grounds to sue the social worker, head nurse, and/or nursing home? If so, what are the correct terms for the grounds to sue?
My father has terminal cancer and has chosen to starve to death, much easier and less pain for him. He talked it over with his chemo onco and internist who agreed with him. he made his decision and let us know what he wanted. my mother and I are unable to lift him to care for him at home so he had to go to a nursing home. we told them upfront why he would be staying at the home and they had no problem with it. the second day he was there, the social worker bellowed into his room saying that she could not allow him to die. she is not a nurse or doctor but would not allow it. she was talking so loudly that everyone in the home could hear. since loud noises upset my dad, we asked her to step in the hall to talk. she verbally attacked my mother, loudly. mom has extremely high blood pressure and takes strong meds for it daily. after a few minutes of the social worker yelling and accusing us of horrible things, I felt my mother's hand on my shoulder and turned in time to catch her - she passed out. the social worker didn't offer to help in any way at all but kept yelling. she finally said she'd have to check with administration on something but would see us later. this all upset my dad greatly. later, we had a meeting with the social worker and head nurse (yes, registered licensed nurse) for the hall. they both verbally attacked again. mom passed out again. again, no help was offered. they said dad couldn't make that decision without being declared competent by their psychiatrist who would be around sometime. dad's internist has resumed being dad's dr of record and he is getting what he wants. his internist said the social worker had no right to be in dad's room discussing medical treatments or questioning his competence. if we had bowed under to the social worker and nurse, he would be in tremendous pain by now with no way out. almost 2 weeks have passed and no sign of psychiatrist.
when mom passed out in the hall, only 1 nurse who happened to be in the hall offered any assistance. the social worker and head nurse could have cared less if mom was having a heart attack and died. were these 2 "professionals" acting negligent, inflicting harm, etc and is the nursing home also responsible since they pay these 2 "professionals"?
