What is the name of your state? WA
Back in January I sent out a validation letter and cease communication by phone letter to a collection agency trying to collect a debt they say I owe dish network. I have recieved nothing to date on the debt. Today I got a call from them trying to collect on this debt. They admitted to me that they had no proof such as finaling billing, contract or anything other than Dish says you owe it. What else can I do? I do have proof that they recieved my letters. I sent them RRR. Is there a site where I can get sample letters that are worded a little more strongly? Also I cant them to remove this from my credit report? What can I do about that?

Have they marked the accont as in dispute on the credit report.? If not, they've violated the FDCPas well as the C&D letter. PLus, continuing to try and collect before validating. Sue them!

Amazing, a CA that actually follows the law. Is Wa. a one party consent state? If so, go to Radio Shack and buy a $20 recorder and tape your calls and see if they violate the C&D again. I assume your're familiar with the FDCPA

809 deals with validation. So far, it looks like they've ceased collecting if the account is marked in dispute.
You may need to start working this from the CRA end. Dispute with the CRA as not mine and see what happens??? If they verify with the CRA prior to validating with you then, you've a really good violation. Just not sure if you need to demand validation again prior to disputing with the CRA.

Thank you! I have tried toget it off my credit reports, they refuse to remove the item off. Also they are still trying to collect this debt. It has been in dispute for over a year.
