my husband and his ex have been divorced for 5 yrs they had joint custody she had physical but last year his oldest son wanted to live with us so we made out a papers stating that we each had one child and so neither had to pay child support and my husband and the ex both signed and had it notorized he still lives with us she had a new baby and filed for food stamps and now she is trying to get back child support even though we paid 3 months of child support after he moved in with us he has a court date monday What should we do?????:mad: OH yeah not to mention he went to visit earlier this summer and his step dad picked him up off the ground and then started chocking him 4 days later when we picked him up he still had bruises on his neck turned it over to dhs and nothing happened

ummmm . I hate to break it to you, but you are not your own personal court of law. Until a court decides to modify the child support and custody it remains the same, regardless of your notarized paper. You should go to court, provide the information that you have, and pray for the best. by the way, the rest of your post is apparently unfounded and definitely irrelevant.

PS. A court date on Monday and you are just now asking questions, you need to consult an attorney if you can afford one and legal aid if you can't.

Wow. My own personal crystal ball (not the official FA one, Rmet doesn't like me enough to share) says that hubby is screwed. Legally, he owes the money, and if mom is on welfare, the state's gonna want to be paid back.

This did not absolve him of his responsibility to pay her support. He should have filed for a modification through the courts. He owes the money. Too bad, so sad. Hopefully, by now y'all realize he needs a lawyer as neither of you know how the legal system works.

just found out today since we have the paper she signed DHS dropped the case b/c of things that she had not filed she has to pay court cost and we are going to help her out and pay half:D
