Need help distiguishing weekend parenting time

I need advice.

My court order says that I am to get 2nd and 5th weekend parenting time with my children. So, I am thinking that this is my 5th weekend time with my children. My ex had told me that he had made special plans for them that he had done months ago and said that they would be crushed if they had to cancel because of me and that he would not be bringing them this weekend.

I received an email from my ex this morning saying that he had talked to a GAL and "explained" the situation and she said that I was definitely wrong and they would have no problems in court backing it up. He then proceeds to tell me that I would have to give a weekend in September that I wasn't even expecting to get in the first place.

He said that I would now have them this weekend and the weekend of the 14th (which was the weekend I was expecting anyway) instead of the weekend of the 7th and the weekend of the 28th.

My weekends start on Friday and end on Sunday. Am I looking at it right?

So what do I do? Who is right?

I have a call into my attorney but they are not in the office yet.

This would be the fifth weekend in August. And the second weekend in September would be the weekend of the 14th.

If your weekend begins on Friday, then I would call this the 5th weekend. However, if it begins on Saturday I would call it the first weekend. You need to call the GAL yourself and find out how to define the weekends.

what you all are saying but we don't have a GAL assigned to our case. The GAL he is talking to is someone who goes to their church and more than likely only knows part of what is going on.

I myself consider this the 5th weekend in August.

My weekends start on Friday.
Then this is your weekend and you would get only one weekend in September, the weekend of the 14th.

However, if they really have special plans, then you could accept the weekend of September 28th as a makeup weekend, if you were inclined to do so.

Wait....I just thought of something. This is Labor Day weekend so its a holiday. Holiday visitation supercedes normal weekend visitation. Whose holiday is it?

Edited to add: I have decided to give my ex this weekend since he had already planned something special for our children. I told him that I would take the weekend of the 7th and the weekend of the 28th. I also let him know that my weekends start on Friday. But I also told him that we need to communicate better with each other and that our children deserve that.

Am I stupid for doing this?

no you aren't stupid- you avoided ruining the children's plans and also got yourself a makeup weekend.....get going on getting that new order;)

Well

after letting my ex know that he could have this weekend, I received a nasty call back from him saying that it was too late to have a change of heart because he had already changed plans.

I noticed on his email after looking at it for the millionth time that he had copied his attorney's assistant on the email and I am wondering if she corrected him or if called her and found out he was wrong and is now pissed at himself and then tries to make me out to be the bad parent.

I don't know but I am going to make the best out of this weekend. Hopefully my children won't be too disappointed.
