need help facing four felonys in georgia.

I had to protect my daughter from a bunch of punk girls. Now they have me for terroristic threats and battery and aggravated assault,and somethin else. It is all crock, I had filed three or four police reports, but the cops said they could'nt do anything until they assaulted her. well is'nt that a little to late. Please help it has been 16 months since my arrest I turned down 3 plea bargins that the D.A. offered me. My public defender is worthless. help.

My response:

You may think you're innocent, and you may think you were justified. But, I also think your defense counsel was trying to save you. He had to have mentioned to you the "Three Strikes" law? If convicted, on 3 or more felonies, you're going away for a very long time - - and that's assuming you have no felonies in your past.

I think the 3 Strikes law refers to 3 separate instances. This would all count as 1. The purpose of the law is to give one or two time criminals a chance to get their act together. Committing 3 crimes in one sitting doesn't allow you errr... a criminal to so that.

As far as your case goes, adults get screwed when it comes to violence against minors. Go to court and get your lumps.

My response:

There were more than 3 separate instances. Remember, he said there was a "bunch" of girls? Each one of those girls that he struck qualifies as a "separate instance" because each of those girls are entitled to their own separate Constitutional rights, and each one of those girls that he struck constitutes a separate crime.

All because this happened at, perhaps, one place and at one time, it doesn't matter. Each battery is counted as an "instance" in the law because each battery took place at different times - - e.g., even if each battery took place 1 second apart.

I am a 45 year old single mother, not a man. And I did,nt hit anyone only told them to leave my kid alone. no battery no hitting. So whoever Liable is you just dont relize that these girl beat a little girl so bad she spent a week in the hospital. Would you just sit back and wait for that to happen to your child.If so you are not a parent. I am not an angel, dont claim to be but I will not hurt any kid unless it waS SELF DEFENSE. I am only a parent put in a bad situation and handeled it to best of my ability. But I did,nt touch any of the 8 girls, who were gonna jump on my one daughter.

Not that I like to condone any type of violence against a kid, but underneath it all I agree with the Mom here. In fact, if it were legal I would hope she would have knocked the snot out of all 8 of them and stomped them into the ground. Some kids just tick ya off, and where the h**l are their parents anyway?
