in california: is there a law that protects me from not having to buy out my partner's investment when i can't afford to, just because he wants out of the partnership? i would like him to buy me out, too.....but now he is taking me to small claims court.

My response:

Let him sue you in Small Claims court. He'll just be wasting his time. Small Claims court, in California, does not have jurisdiction to hear partnership division cases; e.g., lawsuits for partition or specific performance. He'll need to sue you in Superior Court. So, at least for now, don't sweat it.

thanks for info, but i think i need to know what code to try to look up, because he's wording the claim that he never took any ownership of the item we are in partnership on, and therefore is claiming back his investment as reimburseable expenses. i just don't get this, and think i'm going to get tripped up in court on friday.
