I need help with a judgement. There is a default judgement against me filed in 2000 for a business warehouse lease. I just learned of the judgement in 04/2004 when they served me with debtor's examination. I tried to vacate it but the judge denied it saying it's over 1 year from the date of original judgement.
My question is, I got married in 2001 and since the judgement was entered prior to my marriage, is my wife responsible for the judgement amount? If my wife is not responsible, where can I find the law that says that?
The reason why is the plaintiff filed a general levy against me on my address and also filed Abstract of Judgment. With general levy, I think the Sheriff can come to the house and take furniture/TV/Computer and sell them at auction (maybe?). I just want to make sure that they can't force sell the house to collect the judgement and can't touch my wife's savings. I think that this is my problem and I should deal with it but now that I am married and the California community property law is really confusing me.
