Need Help with a Real Estate Situation Please

I have found that my residence which was supposed to have been foreclosed and auctioned off on April 12, 2010 was never auctioned AND there has been no foreclosure per county land records/deeds. There is a family living in the house who appear to be paying rent or mortgage to SOMEONE.... not me. I am only "assuming" they are not squatters due to the condition of the home from the outside. The mortgage company says they have no records on file of my account and refuses to respond to my letters. Cust Serv adv I needed to send a letter in writing which I have done. I don't know how to deal with this matter. The house is still in my name, there was no foreclosure and someone is living there and it isn't ME. Of course, I initially left the property out of fear of being evicted by the sheriff.....especially since I was given an auction date.

By the way, just as a side note. I have noticed that the attorney's who originally sent me all of the foreclosure papers regarding the auction, etc. has been hit with quite a few "law suits" ...Im not really sure what that is all about but I need some guidance with this.

Any and all information will be greatly appreciated.

It may indeed have been auctioned off and bought by the bank. The banks are real *******s and delay recording the deeds on REOs until they have a seller. This gets them out of responsibility for taxes and HOA fees (believe me, we've got a few foreclosures in our neighborhood).

However, it quite possibly could be some rental fraud. There's a lot of this going around with both foreclosures and just properties listed for sale. Some "landlord" rented the house my daughter was under contract to buy. Fortunately, the current (legitimate) tenants were still there to keep the new guys from succeeding in moving in.

I would be inclined to believe that the bank is holding off from recording the deed until they have a seller. The problem with that is ...the house is NOT for sale. It is just sitting there with someone living there in MY NAME.

Question - if this home is indeed still 'in' OPs name, what about his possible insurance responsibilities? If some one is injured on the property, if the house burns down...?
