I live in Nassau County in NY. Ive been living in an illegal basement apartment since Sept.99. The landlord took me to court because he wanted a new lease and I ended up getting an agreement for him to make several repairs by December 1, 2000. He has not made any of the repairs. I also had the police in my house because he was videotaping against my wishes. He videotaped my infant daughter, my husband and myself. I asked him to leave several times and he refused. What recourse do I have? For the failure to comply with court agreement and for the invasion of privacy and harrassment?

Yes, you have 2 separate cases. If he was inside your property uninvited, then nail him for trespassing and illegal entry also.

WE ALLOWED THE LANDLORD TO COME INTO THE HOME UNDER THE PRETENSE OF INSTALLING A CARPET. NEEDLESS TO SAY, THE CARPET WAS NEVER INSTALLED. HE THEN TOOK OUT THE VIDEO CAMERA WHICH HE HAD CONCEALED IN HIS COAT. HE REFUSED TO LEAVE, BUT WE LET HIM IN. DO WE STILL HAVE RECOURSE FOR INVASION OF PRIVACY (VIDEOTAPING US IN OUR HOME AGAINST OUR WISHES)?

Sorry about the caps.

I let the landlord in and then he took out a video camera that he had concealed in his coat. He entered the house under the pretense of installing a carpet. He never had any intention of doing that. My question is.....can i sue him for invasion of privacy and harassment as well as failure to comply with a court order?

Yes. Give him the gas. And if your infant daughter had no clothes on sue him for perpetration of child pornography.

Regarding repairs, there is a jurisdictional problem in having the District Court in Hempstead enforce that portion of the agreement. But it has been done.

For the videotaping and remaining on the premises against your wishes, you have valid claims, best used as leverage only, because you probably won't want to pursue them.
