Need help with Yahoo Auction Fraud

I won an auction for a portable DVD player at Yahoo auctions.
I paid the seller via BidPay.com
The seller disappeared, never sent me the DVD player.
However he acknowledged receiving the payment.
He just disappeared.
I notified Yahoo buyer protection.
They have a company Cynosure that handles fraud claims.
Cynosure told me to contact my credit card company.
I paid BidPay via a credit card. Then Bidpay sent a money order to the seller.
Well I explained the situation to my credit card company and they credited the account the removed the payment for the DVD player.
Meanwhile Yahoo/cynosure decided to approve my claim and is sending me $75. The DVD was $100 - $25 deductable. Now I paid bidpay 117.42 so they charged me $17.42 for the service.
They sent me an email this week notifying me that I am responsible for the payment still according to my contract with them.

Here's part of the letter from them
d. Notwithstanding anything in this Agreement, if, as part of the BidPay Services, you purchase a money order or instruct us to provide Direct to Bank Services, (i) in addition to the terms and conditions contained in this Agreement, you are also subject to all terms and conditions appearing on the face of such money order or imposed by the originating, intermediary and/or destination banks and you hereby agree to comply with and be bound by all such terms and conditions; (ii) in the event that such money order is fraudulently cashed or stolen or the money is fraudulently directed to the wrong bank, BidPay assumes no liability and you agree to assume all liability; and (iii) BidPay's obligations with respect to such Direct to Bank request or money order are complete upon BidPay's (a) deposit with the designated financial institution, or (b) deposit of such money order in the mail or with a recognized courier service.

I told them I knew my credit card company had removed the charge. I also told them that cynosure might be sending me a refund but not for the full amount.
That they should share in the lost perhaps.
Anyway they said they would accept a payment of 93.93 which is a 20 percent discount.
Otherwise in October they they will place my account with a collection agency. Should I ignore them? Should I pay them something.
When and if i get the additional money from Cynosure, should I send it back.
Should I tell Cynosure that the credit card company has removed the charge but Bid pay is threatening me? Thanks for any advice you can give me.
