Here is my situation, me and my spouse has always filed jointly, and 3 years ago she started where the people was paying her personnel checks and them not claiming it. She told me she didn't want to claim it because she didn't want to risk her job getting the people in trouble, well now me and her is about to go through a divorce. Can I get in trouble for her tax evasion please give suggestions!!

Yes, that is called tax fraud. You knew about it and deliberately filed the return knowing she hadn't reported it.

Either amend the returns and pay the tax, penalty, and interest, or hire an attorney.
