I currently live in California. I have a wonderful 2yr old son out of wedlock. My name is on the birth certificate. I have my son at least every weekend if not more.

I know my exgirlfriend wants to move out of state she is in the Military. She is planning on getting married and thinks that my son should stay with her soon to be husband and her two other kids while she is gone for 4-6 months.

I think that my son is our responsibility and if she is going to be gone for any length of time he should be in my care, just as I think the other two kids should be with there father not her husband.

My question is legally can she leave my son with someone that I don't approve of for such a length of time?

My response:

Yes. And, this will happen as long as you fail to spend the money on an attorney to obtain a custody, visitation and child support order. So, the longer you wait to exercise your rights, the more she's going to finally decide to do this to you, regardless of your feelings.
