Question is for my brother. State is Arkansas.
My brother had a debt show up on his credit report from a phone company. All he has found out is that the debt was back from 1994 and it was put on his report twice in Nov. 2000 when the old phone company was bought by the new phone company. When this debt took place my brother was 17. This also has hurt his credit report and because of this had to have a co-signer on his new truck. My brother is very new with these credit stuff and doesnt know what to do. All he gets is the run around from the phone company. They will not give him the info he has asked for. He has told them that this is not his debt and he does not owe it. And they need to send him proof that he does. All they want is the money. Were they in the wrong to report this to the credit bureau after 6 years. This debt showed up after my brother got his second bank loan. He had excellent credit till this showed up.
Thank You!

Someone may well have a better idea but, here goes. If he has proof that this was charged off in 1994, he needs to send a copy {RRR} to the CRA's and ask them to delete because the chargeoff is over 7 years old. They'll probably try and verify with the orginal creditor and, if the phone company verifies the debt, they've violated the FCRA and, he may sue for up to a $1K in damages in small claims court.

You may want to post this at www.creditnet.com for some other opinions.
