OLD SON IN THE APARTMENT WITH THEM, WE HAVE NO LEGAL SEPARATION PAPERS DRAWN UP-NO PAPERS HAVE BEEN DRAWN UP AT ALL??? I HAVE BEEN TOLD BOTH WAYS ON THIS MATTER, NO AND I CAN TAKE LEGAL ACTION AGAINST BOTH OF THEM AND YES SHE CAN SLEEP WITH WHOEVER SHE WANTS IN HER APARTMENT WITH SON THERE??? SHE ALSO GOES TO HER FRIENDS HOUSE AND STAYS ON WEEKENDS, SHE ADMITS SLEEPING WITH GUY TO ME AND GLOATS THIS IN MY FACE, AND ANY OTHER DAYS SHE CAN GET ME TO WATCH SON, IS THIS LEGAL TOO??? I believe that is correct in NC. However, unless you can get a judge to order that her boyfriend can't spend the night when your child is present you are sol.

NC does have laws against co-habitation...but you have to get it into court. There is nothing you can do without court orders.

File for divorce using adultery as grounds and be able to prove it. Get custody of your son.

If you are able to accomplish both of these things, you can be the one gloating in her face. You won't have to pay alimony to her and she will have to pay you child support.
