What is the name of your state (only U.S. law)? Texas my fiance was sentenced to 18 months state jail. He has been in Smith co jail since 09/22. He was on probation in 2 counties and has another court date on 12/14 in Henderson co, for violation of probation and possesion of controlled substance >1g, his probation in this county is for deadly conduct discharge of firearm in 2004 3rd degree felony. I have several questions, is there any way to get out early in state jail, we were told state jail time is day for day no good time or parole. Another thing I was wanting to know is would it be better for him if he gets prison time for the other charges he has not yet been sentenced for, because then he would have the option of being paroled. Any information would be greatly appreciated.

There is no early release or parole from state jail. Yes it is day for day. The courts where he had settings might bench warrant him there but it is unlikely. He will most likely be extradited there once his term in state jail is up. He should get credit for the time he accrues in state jail so with that credit he should just negotiate the best plea deal he can on these other charges.
