What is the name of your state? NY The company that I own is in the process of suing someome in NYS Supreme Civil ourt for nonpayment of services that I provided to his company as a subcontractor. In the mean time he has been going around saying lies about my company which has caused us to lose business which my lawyer has brought into the suit. During a taped conversation that an employee had with this individual he threatened to bring down my company at what ever it takes and that my Daughter sleeps with the N word. This absolutely not true, during this conversation there are witness present and his lawyer heard this tape, and was stunned. Can my daughter sue him for slander or whatever.

Well, technically, under certain circumstances, actual damages are not required, the law presumes them. They are:
* imputations of criminal conduct
* allegations injurious to another in their trade, business, or profession
* imputations of loathsome disease
* imputations of unchastity in a woman

So #4 could potentially apply, especially if the daughter is an adult and is married to someone who's not black. Of course, you'd still have to prove he said the things he said, that they are not true (and that other people heard him). Meaning, unless you want to know more than you thought about your daughter's sex life (and be prepared for some surprises), you may want to re-think this one.


PS: There's no such thing as "Supreme Civil" court. It's either Supreme or it's Civil, but not both.
