Need legal adviceon auto accident! Please read!

i was recentely involved in a fender bender. the person i hit had had his liscence suspended prior to this, and was arrested at the scene. i was wondering, what would the logistics be of a lawsuit against him, as he was not supposed to be driving at all?

(please note: this is not a defense case, i am not defending my failure to slow down to avoid a collison. this is a lawsuit against him for driving illegally; that is if he were not there, i would not have hit him.)
