As a good gesture and to be helpful to a former friend, I co-signed on a rental car that turned from a two week rental to a 4 week rental back in September. She verbally promissed me that she would pay me back within two weeks of returning the car, and has kept prmoissing that she is waiting for a check to clear to pay me. It is now the end of January and she hasn't fulfilled that promise. Can I take her to small claims court to get my money back? Does verbal agreements hold in small claims court?

all i can say is that more often than not, verbal aggreements never hold up in any court, especially without witnesses

While I agree with slpkn's assessment I also believe that you have documentation of your agreement.

You have the car rental agreement, only your friend has use of the car. No reasonable person is going to believe that you rented a car for your friend as a gift without expecting to be repaid.

For this reason, I suggest you file a case for your damages in small claims court, the worst that could happen is you'll lose - and in this situation I don't see that as very likely.
