What is the name of your state? wisconsin
ok my wife and i got the kids back last night after being at their dad's for 5 days( 50/50 custody) one of the boys just looked like he got the crap kicked out of him, bruises, fat lip, bloody lip..ect..) we have had a run with the police as of late and they don't do anything, as a matter of fact the last time they were over they told my wife to settle her and her ex's disputes by themselves. the kids told us their dad was "punching" them and hits them in the stomach all the time. i took pictures of all the marks and even some that look like belt marks on the inside of the thigh (like a belt wrapped around the leg). i then called our attorney and left him a message. mainly because the cops and S.S. do nothing. now we have also been told their dad takes showers with them and is telling them not to tell their mom or me anything that goes on there "or they will be grounded for a month". does anyone have any clue as to what age the courts and poeple frown on the showers? the boys are 8 yrs old........ thanks any other opinions are welcomed as well. we are going for a restraining order from the kids nowand hoeing the courts have had enough of this guy.
thank for advice

And why haven't you taken the kids to the emergency room immediately after picking them up and finding the bruising and 'fat lip'?

Screw the police. A doctor is required to report child abuse if suspected and although that would also involve you and the wife, as long as you can document that you picked them up and took them immediately to the emergency room, you'll be o.k.

Also, why haven't you involved child protective services?

Calling your attorney is o.k. but he/she can't do a thing for you outside of court. And if this behavior is all you say it is, can you really wait for court?

P.S.

By the way, just so you know, you and wifey could also be held under the Wisconsin Child Abuse statutes for not reporting the incidents.

Emotional abuse is defined as "Emotional damage for which the child’s parent, guardian or legal custodian has neglected, refused or been unable for reasons other than poverty to obtain the necessary treatment or to take steps to ameliorate the symptoms." [Ref. s. 48.02(1)(gm), Stats.]

And here is your definition for physical abuse. sound familiar?

Physical abuse is defined as "physical injury inflicted on a child by other than accidental means." [Ref. s. 48.02(1)(a), Stats.] This includes non-accidental injury inflicted by any other person. " ‘Physical injury’ includes but is not limited to lacerations, fractured bones, burns, internal injuries, severe or frequent bruising or great bodily harm, as defined in s. 939.22(14)." [Ref. s. 48.02(14g), Stats.]

To report the abuse go to http://www.dhfs.state.wi.us/Children/CPS/cpswimap.HTM then click on your county and you will be directed to the correct office.

a)well the only way i can answer this is to be 100% honest. my wife was to distrought to call anyone, last time i called i was told i had to have my wife call since they are her kids and lastly, because i was trying to listen and completely understand what was beign told to us by the kids, they have a tendency to talk quite fast when their are "pumped up".

a) obviously you don't know what kind of losers.i mean doctors we have by us. ( example.. i was accused of burning the kids with cigerettes a few years back, after the ER doc and child doc looked at the child i got accused of sexual assault, then finally after haveing put a 5 yr old girl through all the sex tests they uncovered that she had a skin rash).... now do i trust any of the docs? plus we were told not to do anything that would alarm their father about anything until we go back to court for custody 100%.

Also, why haven't you involved child protective services?

a) because like social services and human services no one in this stupid town will do anything, even after talking to a probation officer of the dad's , we were told the gov't offices don't like to do more than they have to unless you have definate proof..( how do we have definate proof? we were not at the house when it happened.

a) i do agree with you i don't feel we can wait thats why i took pictures and wrote down everything that was told to us by the boys, as somekind of record.

P.S.

By the way, just so you know, you and wifey could also be held under the Wisconsin Child Abuse statutes for not reporting the incidents.

a) even after the fact that i cantacted my attorneies office right after the boys got done telling us what happened? it should show something that i have a phone record that i contacted him, shouldn't it?

HOW????

after all the calls and advice. we had the police and CSW at the house last night. after 2 1/2 hrs of interviews with the kids looking at the bruises and bloody lips and what they had to say, how can they tell us there wasn't enough "physical" evidence to take the kids from him until an investigation?

loosing confidence in the judicial system

Physical evidence of who did the act.

They are investigating. Stop worrying about what is not happening and be thankful for what is.

OK maybe i misunderstood what or how they said it. we'll see what takes place. i know they said they were going to call the father and talk to him. our concern is that now he's going to be upset they said something and we have to let them go to his house, guess we just don't want any more to happen to them.

thanks again
