We live in SC. Very long story, just being my Mom has temporary custody of my twin nieces. Dept. Social Services removed them from my Brother's house due to mental abuse being given to them and threat of physical harm. September 24th a Full Merits Hearing is scheduled. Should my Mother have an attorney with her to aid in her rights and the girls being protected. I contacted an attorney here and they say not to worry. But I am concerned about such things as child support, child support being paid through the clerk of court so my Mom will not have to contend with my Brother about him not paying, His keeping health insurance on the girls until they are of age (16 now), what does he pay and what is he not responsible for, such as: High School Rings are ordered with $70 deposit and rest due on arrival, school field trip to NY is $900 each, next year graduation supplies are expensive and such as this. He is currently paying car insurance on a car in his yard for them, so they are just driving a car we have and we are not having to pay insurance on them. Can he be required to continue to pay the car insurance? Just want to cover all the bases for their sake and my Mothers. She is 70 years old raising her twin 16 year old grandaughters. Thank you for any help and advice. God Bless!

She can make all these request on her on behalf. Just tell her to keep all things she is wanting or needing written down.

I have a concern here though, and I mean this very respectfully, but since your mother is 70, isn't 2 16 teenage girls a little much on her. I mean, My father is 77 and my mother 69 there is no way I would want them raising my teenage. It is to much. They have lived their lives.

Of course if you Mother is truly wanting this, then I wish her all the best. I just hope a Judge will allow it at her age.

Good Luck to you all.

Get that Attorney!!

I agree- isn't it a bit much on her to be raising twin 16 yr olds? I am not saying she can't; but I certainly hope you are there for her. SHE'D BETTER get that attorney!! One of the FIRST things that will be brought up by his attorney in an attempt to persuade the judge to return the girls to their dad is Mom's age. Plus, most older people don't now very much about the law and also get very nervous when pressured. Suppose his attorney starts badgering her under questioning, if she has to testify? She's not aware of what she can to object to, or what evidence to present on her behalf. If she has legal counsel there, her rights will be protected, and then HER attorney can present evidence on her behalf. The best to you, Mom and the twins.
