What is the name of your state (only U.S. law)? Texas
My son who is in the Army came home on leave and got married, well to make a long ugly story short, he now realizes that he made a mistake and now wants out of the marriage, BUUUUUUUUUUUUUUUT, his wife if pregnant, we arent sure if this is his child or not. Can he start the process of getting a divorce?

He can start, sure, but nothing will be finalized until the child is born.

And legally, the child is his - or at least until he requests a DNA paternity test as part of the proceedings. It is CRITICAL that he doesn't miss this step, since once the divorce is finalized if he hasn't disestablished paternity then he's on the hook regardless of biology.
