need to break lease

my husband broke his hand at work and is going to have to have surgery on it. we have 3 months left on our lease, but we will not be able to pay this on my salary alone along with all other bills as well. we have an out clause, that is basically paying for the next 3 months minus $100. i am trying to find out if there is a way to get out of the lease without having to pay that much. if we could afford to pay that amount, we would just stay there. what do you suggest we do?

Well what about workmans comp? why isnt he getting it...he was hurt on the job?

What about his insurance? is he union?

I doubt that 3 months termination fee would hold up in court, unless the landlord cannot rent the place fast, If your place is seasonal, or in a college town or near the water in winter, and is really unrentable certain times of the year.

You are liable for every day he doesnt get any rent, BUT it is Illegal for the landlord to get rent from 2 different people for the same apartment......so you will have to sue the landlord, or he will sue you... and let a judge decide if the landlord has just and valid reasons why 3 months termination fee is reasonable.
