Q: received subpoena for deposition & records from defendant's attorney dated 5/9/05, to appear 6/30/05. Have been in cordial schedule negotiations by phone thru intermediary who happens to be second attorney for plaintiff in current case & also was our attorney many years ago when we entered into an agreement with defendant regarding land use. On 5/9, our availability for June & July was requested by telephone thru intermediary, & date for deposition was set verbally for June 13. Defendant's atty canceled on June 7, & requested our August availability which we gave to intermediary on June 13; INTERMEDIARY is to get back to us as soon as he arranges with DEFENDANTs attorney. Yesterday (June 14) we are served with subpoena issued by DEFENDANTs attorney on May 9, to appear 6/30 (a date NOT included in our June availability, as we live in 2 places & will be in the other place on June 30). What should we do?? We don't want to get in trouble, but we think it must be a mistake. Please help!! Thank you in advance.
