Per the UCCJEA, Tx has jurisdiction over the children (Mom can file a SAPCR - Suit Affecting the Parent-Child Relationship, immediately & have child support & custody & visitation issues resolved).
However, to file for divorce, Mom has to have been a resident of that county for the preceding three months & Texas must have been her domicile for the six months preceding the divorce filing.

What most parents do in these circumstances is: file a SAPCR for immediate resolution of the 'child' issues, then when the appropriate amt of time has passed, Mom can file for divorce (usually under a new cause #, and then they file a Motion to Consolidate the causes under the divorce decree cause#).

OhioGal stated the statute correctly.
Tx Judges have fairly wide discretion in deciding whether there is an appropriate amt of time for jurisdiction.What is the name of your state (only U.S. law)?

Thank you GL. Tried to send you a PM but you exceeded your quota. It is good to know about the SAPCR - Suit Affecting the Parent-Child Relationship and that that is an immediate option. That helps needs quite a bit giving her an immediate option to get some things started.
