I have a 13 yr old daughter that was at an establishment and purchased a pair of earrings which she had the receipt for but was stopped on her way out of the store and told she had stolen 1 earring off another earring holder. I, her parent was not with her but her friends step dad was and asked to see the video from the cameras that showed my daughter did it. He was told by the assistant manager that their cameras did not work. No police were called. I contacted the headquarters of this business and they investigated it and found there was no evidence showing my daughter had taken anything and that the assistant manager did not follow the procedures for shoplifting. The Corporate office sent my daughter a letter of apology and a $25 gift card for the incident. Thought it was over there boy was I wrong. The store manager took it among herself to file a complaint against my daughter 3 weeks after the incident. Now there is a court date for a premilinary hearing on Aug 20th which is 16 days after my double lumbar fushion surgery and I will be lucky to be walking then.
I know that when a judge sees the information I have and pictures of missing earrings on the holders that are still out for sale that the case will be dropped but I am trying to get this taken care of before the court date since I am not sure at that time I will even be walking not to mention I am not supposed to be in a car or drive for 3 months.
I have left messages for the prosecuting DA to call me back but havent heard anything back yet. What are the chances of this being dropped between now and Aug 20th?
