Negative Feedback on eBay

What is the name of your state? Florida

I purchased an item on ebay and the transaction was flawless.

I left positive feedback for the seller who resides in New Hampshire.

Never got feedback in return so I sent a pleasant email requesting it. What I got was, first, an email where the seller ranted about how she hated people then, second, negative feedback telling others to BEWARE as I was demanding.

Small stuff, however, I have been on ebay since 1999 and had 802 positive feedbacks, no neutrals or negatives until this.

eBay has a process where you can mutually withdraw feedback so I sent her the following note as part of this process:

"Remove the libelous and defamatory feedback immediately. That and the inappropriate email you sent constitute harassment. I will proceed with litigation, sent to her address, if unresolved."

I really do want to sue if she does not agree to remove the post... do I have to hire an attorney in her home state? What else should I do?

Well if you have alot of money laying around just send it to me because the result will be the same as if you hired an attorney. And with me you won't have to spend all that time in the courtroom waiting for the judge to ask you why you are there.

Unless you can prove alot of damages (loss of money) from this one posting you will never get anywhere in the courts. Use any method ebay has to try to satisfy yourself here but the courts don't want to get involved here.

Squaretrade -- but yeah that is why I never push peps I buy from to leave me feedback... quess the person was in a bad mood and took it out on you....

You're wasting your time even thinking about taking your sourpuss seller to court. Use whatever Ebay procedure you have available to try to get the neg removed. Sometimes it works, sometimes it doesn't. You do have the option of answering your seller's rant with your own response right below hers. You can also respond in your next 5 or ten + feedbacks with a comment like "good seller, unlike the bitch who left the unwarranted - ".

Ooohh, it is considered extremely rude to request feedback from a buyer or seller. I have found about 10% of my buyers do not leave feedback but I really don't worry about it. I sell on eBay to make a few bucks, not to get positive feedback. Personally I always leave positive feedback if it is warranted, if not, I leave none. This has prevented a lot of hassles such as this.
