negative PTO

I have a friend who is a salary exempt employee, she has been employed there for 18 months. Right at her 1 year anniversary when she would have received 3wks vacation they changed over to a PTO system (allowing 5 weeks per yearinstead of 3 wks vacation and 2 weeks sick time).after she was employeed 16 months she took medical leave with her supervisor telling her to just submit the time when she returned and not to worry about taking FMLA. now that she returned to work for 6 weeks, she turned in her 2 weeks notice. Now her employer is telling her that they are keeping her last check and she will have to pay them for the rest of the negative PTO hours. Can they do that even though when other people left with negative sick hours or took vacation (when given up front)and left before they accrued all the time, were not responsible for paying them back.What is the name of your state?

If they're treating her differently BECAUSE she took FMLA, then that's not allowed. But it's pretty common for an employer to make a deduction for a departing employee if he or she has been extended paid time off they hadn't yet earned under the company's policy.

Unless your friend is the payroll person, how would she know how similar situations have been handled for departing employees???
