Recently, my car was broken into in my apartment complex garage, in which my rear hatchback windshield was damaged (over $1000). Normally, it is a secured (gated) parking garage, but it has been open due to an accident over a month ago. I filed a police report, notified my insurance company, etc. Reading thru my rental agreement the very first line states (1) That Resident will not hold Landlord liable in any way for loss or damage to any article belonging to Resident or located in or on said premises or other premises under control of Landlord. However, I have to think that Landlord is negligent in NOT providing gated parking and is partly responsible for the auto burglary to my car. Am I right or wrong? And what course of action can I take if I am in the right? I have been a good tenant for 6 years.

That why you have auto insurance. The incident could have happened even if there were secured gates. L is not responsible.
