I have been living in my home for 8 years and my property ran into my neighbors field. He recently gave this field to his daughter to has decided to put up a fence. We have been maintaining what we considered our property for the past 8 years, but now come to find that part of what we thought was ours, was really part of the field and now belongs to our neighbors daughter. Do we have any rights to this land because we have been maintaining it for the past 8 years. Also, along our property line, we have always been granted access to the field to use as a by-pass to our back yard. If the neighbors put up a fence this will prevent us from using the garage in our back yard anymore. How can I find out if there was an easement on this property to continue to allow us access?

Since you live in no state, you can't get someone else's land by adverse possession. (People who live in states can usually get land after 10-20 years.)

You have no easement for access to your back yard, unless one has been recorded. Go to the county recorder's office and check the deeds for your and your neighbor's parcels. If neither mentions an easement, you don't have one.

This is not legal advice and you are not my client. Double check everything with your own attorney and your state's laws.
