Neighbor filing false reports to Condo Association

My neighbor has filed two reports stating that I frequently allow my dog to defecate in the common area and I do not clean it up. However, this is not true. At times my dog simply urinates, so the assumption is made that my dog created a mess and I left it for someone else to attend to. Unfortunately, my association has fined me $300 for this alleged misdeed. Because my neighbor filed this report with a written complaint sent only to the association management company, could I recover the $300 by suing my neighbor for libel? This neighbor also frequently files complaints for the most minor of offenses and I'd like to put a stop to it. Thank you for any advice that you may offer.

There are thousands of posts similar to yours so I have prepared a standard answer:

Get a lawyer.

Invest $20K and three years.

Sue the bad people for defamation.

If you win, expect them to keep doing it.

If you lose, expect them to keep doing it.


Stand by for other opinions.





I'd also like to point out that the bad neighbor's statement do not rise to defamation in any event. It is rather difficult to allow or stop a dog from heeding nature's call.
