neighbor problem

i am in georgia. my neighbor burned off his yard. he also burned one of the posts holding my fence. i asked if he intended to replace the post. he said no. he said i should have had a water hose ready to protect my property because he had called my wife and informed her of his intent to burn. now the post costs about $5.00, and to install the post would take about thirty minutes. i am no lawyer but i feel confident that a judge would instruct him to have my fence repaired. my question is--is this a small claims court matter? is this a letter from a lawyer matter? is this a just shutup and fix your own fence matter? if i sue can i sue for job time loss to pursue this matter? can i sue for court/attorney fees? can i reclaim small claim court costs? what should i do?

Sorry, but do to the petty nature of this problem, I believe that it is a matter for the teacher to slap both of you upside the heads.

Geez, as if the courts didn't have enough real problems.

However, if you absolutely insist on pursuing this very minor issue, it is really your choice:
1) You can give a lawyer about $50 to $100 to write a letter (it is more expensive than usual since he will probably spend a lot of time laughing while researching the laws).
2) You can take Small Claims action against him.

In any case:
No, you cannot recover for job time loss. No, you probably can't get legal fees. Yes, if you win, you will recover your costs of Small Claims.

I assume you could figure out what you should do from my response.
