Neighbor refuses to finish building fence

What is the name of your state? OKlahoma

I moved into a home 15 months ago. At the time I moved in the previous owners said they had paid for a fence to be built between our property and our neighbors. Our neighbor told us he would finish it that weekend. 15 months later and several chats with him about it, its still not done. Previous owners said they paid $400, he said they didn't. I am in the process of getting the cancled checks. He refuses to finish the fence and challenged me to take him to court. I would rather not take him to court but I really need that fence. What should I do?What is the name of your state?

And where EXACTLY is the fence located? On who's property?

We are in a neighborhood and I am assuming the fence is staight down the line between his property and ours.

That's the first problem. The law does NOT assume.

So, when you get the correct legal answer, come back.

Build the fence yourself, then sue the original owners for reimbursement.

EDIT: Or, if you can get proof that the original owners paid for the fence, and are willing to sign over this obligation to you, then you can sue the neighbor for reimbursement of the $400.
